Terms and Conditions

Your purchase of tickets to events or other items supplied by us constitutes your agreement to the following terms and conditions, and Terms of Entry.

Advertised ticket prices

Ticket prices include GST where applicable, but are exclusive of ticketing fees and credit card surcharges which may be added at the checkout.

TERMS OF ENTRY

Botanica Festival runs from the 2nd to 3rd September, 2023. Daily times are from 1pm til 5pm, times will be advertised on the Botanica Festival website and appear on your tickets.
Entry to the event is via The Australian National Botanic Gardens car park in Acton, ACT, 2601. Your e-ticket is required for entry to the event, there is no box office and they must be purchase online at botanicafestival.com.au. You will need either display via your smartphone or have a printed copy for scanning.
Botanica Festival will offer a range of alcoholic and non-alcoholic beverages, hot and cold food vendors, snacks and botanic products. You will not be allowed to bring any food or beverages into the event and Botanica Festival is strictly no BYO alcohol. Botanic Festival is a strictly no smoking event. Entry is restricted to 18+ and your ID will be checked upon entry. This restriction includes infants.

The unauthorised re-selling of event tickets or offering for sale, transfer or attempted transfer for profit or commercial advantage is not permitted at any time. This includes any use of Event tickets for advertising, promotion, or other commercial purposes.
Pass-outs are not permitted.
A change in personal circumstances or an incorrect purchase DO NOT qualify for a refund or exchange. The Organiser may consider such a refund at its own discretion. Tickets are purchased as non-refundable items except as required by law &/or specified by the Live Performance Australia Ticketing Code of Practice.
Pets or animals are not permitted to be brought into Botanica Festival. Registered guide/companion dogs are accepted in accordance to The Australian National Botanic Gardens rules.
The Organiser reserves the right to change the Event date or venue, and should it be necessary to do so, the Organiser will use all reasonable endeavours to notify Patrons of the change, all tickets will remain valid, and refunds will be offered to those who claim one. The Organiser reserves the right to alter advertised event times, attending brands/vendors, and the program if required to do so. No refunds will be given for program or vendor changes.
The Organiser may at its own discretion refund Patrons if the Event is cancelled due to calamitous weather, an act of war or terrorism, or any event outside the control of the Organiser, collectively referred to as a Force Majeure event.
Any patron possessing a prohibited item will not be admitted and/or evicted from the Event. This includes any of the following: glass, weapons, lasers, fireworks, animals (excluding authorised guide/companion dogs), drones and illicit drugs. Any patron found to be possessing a prohibited item will have it confiscated and it will not be returned. Depending on the item found the patron may be evicted from the event at security and managements discretion.
Any patron possessing alcohol may be prohibited from entering the premises. The event area is a licensed space and any alcohol found will be confiscated.
If you are removed from the Event and/or denied entry to the Event, you will not be entitled to any ticket refund and/or compensation.
Ticketholders must be 18+ years of age to enter licensed event and will be required to show valid photo identification. Ticketholders without valid photo identification will be refused entry to licensed areas. No refunds will be given if you are refused entry.
The Organiser reserves the right to refuse a Patron admission to the Event and/or to evict any person from the Event if they are affected by alcohol or drugs, or act in contravention of any of these Terms and Conditions.
Gift Vouchers, Passes, or Gift Cards obtained from the Sunset Cinema event are not applicable to Botanica Festival. You cannot redeem these for tickets to Botanica Festival.
The Organiser may vary these Terms and Conditions at any time and will post variations on winterwarmer.com.au. By making a purchase from Botanica Festival & MMR Entertainment Pty Ltd after the Terms and Conditions have been varied, you agree to be bound by the variation.

Accessibility

You acknowledge that while we attempt to provide an accessible venue, in some cases it may not be possible to facilitate access for some people. If you have any accessibility concerns, please contact us prior to the purchase of your tickets. Events which are accessible will be denoted as such. Any special requirements for accessibility will be taken into account if possible and they are made known to us.

Limitation of Liability

You use the venue and the premises for the event at your own risk.You indemnify us against:(a) any accident, damage, personal injury, death, loss, illness or injury to you or a person under your care;
(b) any property damage, loss of or damage to your equipment, materials or other belongings brought to the venues, whether by fire, theft, accident, injury or otherwise; or
(c) any other loss, damage, cost or expense (including, without limitation, loss of profits, business interruption, loss of information, indirect, special, punitive or consequential loss or indirect damage of any kind whether or not such loss or damage is foreseeable, foreseen or known and whether or not we have been advised that such damages may be incurred), unless solely caused by us, our staff or our representatives.

Changes to Terms and Conditions

We reserve the right to change these terms and conditions from time to time as required.

'Ferve Tickets' (Ferve Tickets Pty Ltd ABN 41 074 903 085) operates a system for event ticketing on behalf of Botanica Gin & Spirits Festival the 'Event Organiser'. Any and all issues or claims relating to sale and/or purchase of tickets and the provision of associated event(s) are the sole responsibility of the Event Organiser and Ferve Tickets (or any subsidiaries, affiliates, officers, agents, directors or employees) have no liability for any claims. Ferve Tickets is not liable for any loss or damage arising from the purchase of this ticket. Ferve Tickets cannot exchange or refund this ticket nor associated fees, please contact the Event Organiser with any queries. Ferve Tickets has no obligation to provide a refund or any other financial compensation if an event is cancelled, postponed or substantially altered by the Event Organiser, in which case you should contact the Event Organiser directly. Purchasing tickets constitutes your acceptance of this agreement.
